4. Legal Basis for Processing

Usage analytics data is retained for a maximum of 26 months in anonymized form.

7. Data Transfers

Terms of Service

1. Scope of Services
CreativeMarketCore provides creative marketing campaigns, brand transformation strategies, competitive positioning frameworks, market expansion consulting, and related creative and strategic services as described in individual service agreements and proposals. The scope, deliverables, timelines, and fees for each engagement are defined in the corresponding Statement of Work or service agreement.
2. Service Agreements
Each engagement between CreativeMarketCore and the client is governed by a separate service agreement that specifies the project scope, deliverables, milestones, pricing, and payment schedule. These Terms of Service apply to all engagements unless expressly superseded by a written agreement signed by both parties.
3. Payment Terms
- Invoices are issued as specified in the applicable service agreement, typically with 50% upfront and 50% upon delivery.
- Payment is due within 14 days of invoice date unless otherwise stated.
- Late payments incur statutory interest at 9 percentage points above the ECB base rate in accordance with German civil code (BGB Section 288).
- All prices are quoted in EUR and are exclusive of applicable VAT (Mehrwertsteuer).
4. Intellectual Property
Upon full payment, all final deliverables, creative assets, brand designs, strategic documents, and campaign materials created by CreativeMarketCore for the client become the exclusive property of the client. CreativeMarketCore retains the right to display work samples in portfolio presentations and case studies unless expressly prohibited in writing by the client. Pre-existing materials, proprietary frameworks, and internal methodologies remain the intellectual property of CreativeMarketCore.
5. Confidentiality
Both parties agree to maintain the confidentiality of proprietary information exchanged during the engagement. This obligation survives the termination of the service agreement for a period of 2 years. Confidential information includes but is not limited to business strategies, financial data, customer lists, brand assets, and unreleased creative concepts.
6. Limitation of Liability
CreativeMarketCore's total liability for any claim arising from or related to the services provided shall not exceed the total fees paid by the client under the applicable service agreement. CreativeMarketCore shall not be liable for indirect, incidental, consequential, or special damages, including lost profits or business interruption, except in cases of intentional misconduct or gross negligence.
7. Termination
Either party may terminate a service agreement with 14 days written notice. Upon termination, the client is obligated to pay for all work completed up to the date of termination. Deliverables completed and paid for prior to termination remain the property of the client. Work in progress shall be delivered in its current state upon request.
8. Governing Law
These Terms of Service are governed by the laws of the Federal Republic of Germany. Any disputes arising from or related to these terms or the services provided shall be subject to the exclusive jurisdiction of the courts of Kempten (Allgaeu), Germany.
Refund & Reimbursement Policy

1. Refund Eligibility
Refund requests are evaluated on a case-by-case basis in accordance with the following criteria:
- If work has not yet commenced, a full refund of any advance payment will be issued within 14 business days of the request.
- If work is in progress, a prorated refund will be calculated based on the percentage of deliverables completed at the time of the refund request.
- If all deliverables have been completed and delivered, no refund will be issued. Revision requests will be accommodated within the scope defined in the original service agreement.
2. Non-Refundable Items
The following are not eligible for refund:
- Third-party costs incurred on behalf of the client, including stock photography licenses, ad spend, printing costs, and domain registrations.
- Work completed and accepted by the client during the engagement, including interim deliverables and milestones.
- Strategy documents, brand guidelines, or creative concepts that have been delivered and reviewed, regardless of whether they are subsequently implemented by the client.
3. How to Request a Refund
To request a refund, contact us at [email protected] with your project reference number, the reason for the refund request, and the amount requested. Refund requests will be acknowledged within 2 business days and resolved within 14 business days. Approved refunds are processed via bank transfer to the account used for the original payment.
4. Dispute Resolution
In the event of a dispute regarding refund eligibility, both parties agree to attempt resolution through good-faith negotiation before pursuing formal legal proceedings. The competent court for any remaining disputes is the district court of Kempten (Allgaeu), Germany.
